The Basics

This website is run by GoldWatch Inc. When you see “we,” “us,” or “our,” that’s GoldWatch Inc. We offer this site, including all the info, tools, and Services on it, on the condition that you accept all the terms, conditions, policies, and notices below.

By visiting our site or buying something from us, you’re using our “Service” and agreeing to be bound by these Terms of Service (“Terms”), plus any extra terms and policies mentioned here or linked. These Terms apply to everyone on the site, including browsers, vendors, customers, merchants, and anyone contributing content.

Read these before you use the site. By using any part of it, you agree to the Terms. If you don’t agree to all of them, you can’t use the site or the Services. If these Terms count as an offer, your acceptance is limited to these Terms only.

Our store is hosted on Shopify Inc., which gives us the e-commerce platform we use to sell to you.

Section 1: Online Store Terms

  • By agreeing to these Terms, you’re saying you’re at least the age of majority in your state or province, or that you are and you’ve given us your consent to let your minor dependents use the site.
  • Don’t use our products for anything illegal or unauthorized, and don’t break any laws where you live (copyright laws included).
  • Don’t send worms, viruses, or any destructive code.
  • Breaking any of these Terms means your Services end immediately.

Section 2: General Conditions

  • We can refuse Service to anyone, for any reason, at any time.
  • Your content (not including credit card info) may be transferred unencrypted. It can travel over various networks and be changed to fit the technical needs of connecting networks or devices. Credit card info is always encrypted in transit.
  • Don’t reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, its use, or access to it, or any contact on the site through which the Service is provided, without our express written permission.
  • Headings are just for convenience. They don’t limit or change the Terms.

Section 3: Accuracy, Completeness, and Timeliness of Info

We’re not responsible if info on this site isn’t accurate, complete, or current. What’s here is general information only, so don’t make decisions based on it alone without checking more accurate, complete, or timely sources. If you rely on it, that’s at your own risk.

The site may include historical info. It’s not current and is here for reference only. We can change the site’s content anytime, but we don’t have to update anything. Keeping up with changes to the site is on you.

Some products or Services may be available only online. They may come in limited quantities and can be returned or exchanged only under our Refund Policy.

We try hard to show our products’ colors and images as accurately as we can, but we can’t guarantee your screen will show every color right.

We can limit sales of our products or Services to any person, region, or jurisdiction, case by case, but we’re not obligated to. We can limit quantities, change product descriptions or pricing anytime without notice at our sole discretion, and discontinue any product at any time. Any offer on this site is void where prohibited.

We don’t warrant that the quality of any product, Service, info, or other material you buy or get through us will meet your expectations, or that any errors in the Service will be fixed.

Section 6: Accuracy of Billing and Account Info

We can refuse any order you place. At our sole discretion, we can limit or cancel quantities per person, per household, or per order. That can include orders under the same customer account, the same credit card, or the same billing or shipping address. If we change or cancel an order, we may try to reach you using the email, billing address, or phone number you gave us when you ordered. We can also limit or block orders that, in our sole judgment, look like they’re placed by dealers, resellers, or distributors.

You agree to give us current, complete, and accurate purchase and account info for every purchase. Please update your account and other info promptly, including your email address and credit card numbers and expiration dates, so we can complete your transactions and reach you when needed.

Section 7: Optional Tools

We may give you access to third-party tools that we don’t monitor, control, or have any input on.

You acknowledge and agree that we provide these tools “as is” and “as available,” without any warranties, representations, or conditions of any kind, and without any endorsement. We have no liability for anything arising from or relating to your use of optional third-party tools.

If you use them, you do so entirely at your own risk and discretion. Make sure you know and approve of the terms of the third-party provider.

We may also offer new Services or features on the site in the future (including new tools and resources). Those fall under these Terms too.

Third-party links may take you to websites that aren’t affiliated with us. We’re not responsible for checking or evaluating their content or accuracy, and we don’t warrant or take on any liability for any third-party materials, websites, products, or Services.

We’re not liable for any harm or damages tied to buying or using goods, Services, resources, content, or any other transactions connected to third-party websites. Read their policies and practices carefully and make sure you understand them before you do anything with them. Send complaints, claims, concerns, or questions about third-party products to the third party.

You agree your comments won’t violate anyone’s rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You also agree they won’t contain libelous or otherwise unlawful, abusive, or obscene material, or any computer virus or other malware that could affect the Service or any related website. Don’t use a fake email address, pretend to be someone else, or otherwise mislead us or anyone else about where your comments come from. You’re solely responsible for your comments and their accuracy. We take no responsibility and assume no liability for comments posted by you or anyone else.

Sometimes our site or Service may have typos, inaccuracies, or omissions about product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We can correct any errors, inaccuracies, or omissions, and change or update info or cancel orders if anything on the Service or any related website is inaccurate, at any time, without prior notice (even after you’ve placed your order).

We have no obligation to update, amend, or clarify info on the Service or any related website, including pricing, except as required by law. No update or refresh date on the Service or any related website means everything has been updated.

We can end your use of the Service or any related website for any prohibited use.

Section 13: Disclaimer of Warranties and Limitation of Liability

  • We don’t guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.
  • We don’t warrant that results from using the Service will be accurate or reliable.

  • In no case shall GoldWatch Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise. That covers anything arising from your use of the Service or any products bought through it, or any other claim related in any way to your use of the Service or any product, including errors or omissions in any content, or any loss or damage of any kind from using the Service or any content (or product) posted, transmitted, or otherwise made available through it, even if we’ve been told it could happen.

Some states and jurisdictions don’t allow excluding or limiting liability for consequential or incidental damages. In those places, our liability is limited to the maximum extent the law allows.

You agree to indemnify, defend, and hold harmless GoldWatch Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party because of or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Section 15: Severability

If any part of these Terms is found to be unlawful, void, or unenforceable, it will still be enforced to the fullest extent the law allows, and the unenforceable part is considered severed from these Terms. That doesn’t affect the validity and enforceability of any other part.

Section 16: Termination

Obligations and liabilities that either of us took on before the termination date survive termination for all purposes.

These Terms stay in effect until you or we end them. You can end them anytime by telling us you no longer want to use our Services, or by simply no longer using our site.

If, in our sole judgment, you fail (or we suspect you’ve failed) to follow any part of these Terms, we can end this agreement at any time without notice. You’ll still owe everything due up to and including the termination date, and we may also deny you access to our Services (or any part of them).

If we don’t enforce a right or provision in these Terms, that doesn’t mean we’ve given it up.

These Terms, plus any policies or operating rules we post on this site or related to the Service, make up the entire agreement between you and us.
